Historic UK cargo class actions possible

A legal firm says UK carrier British Airways and other carriers caught up in the EU's cargo cartel action could face US-style class action suits for the first time.

Two flower shippers previously denied the right to form a group to sue British Airways now are waiting for this week's UK Court of Appeal ruling. A ruling in favour of the flower shippers may make it possible to launch a class action model in the UK.

Customer class actions in the UK have never achieved the scale they have in the US.

"In some cases, the class could be enormous," said Jonathan Hitchin, a lawyer at Allen & Overy in London. "It would demonstrate that there is a widely available remedy for those who have suffered as a result of cartel behaviour."
